Welcome to the TrainingClub e-Learning Platform. The website courses.trainingclub.eu, along with its affiliated entities, is an online learning platform operated by TEAM4Excellence ("the Site"). This Site may provide you with access to a variety of online courses, documents, images, graphics, audio, video, forums, discussion groups, and other content ("Content").

By accessing, registering or logging into the Site, you agree to these terms. We may revise these terms at any time. Your continued use of the Site after any such revisions have been published constitutes your agreement to the revised terms. If you do not agree to these terms, do not use the Site. 

Personal data collected when you access and use the Site will be processed by TEAM4Excellence in accordance with the Privacy Policy. For more information on the types of personal data collected on the Site, how we handle your personal data and other related topics, please read our Privacy Policy.


1. Site Content

The Site Content is copyrighted by its authors. When using the Site, you may be able to access or download certain Content provided by our partner organisations. Content is governed by the licence that accompanies it. By using or downloading any Content, you agree to the applicable licence.  It is your responsibility to ensure you have proper permission for your use of any Content. If you are unclear as to what licence applies to any Content, it is recommended that you ask the author.


2. Your Content

Where applicable, you may be able to upload or otherwise provide certain Content, such as documents, images, videos, or other material to the Site via your Account ("Your Content").  Except if specifically stated otherwise, Your Content is not confidential and may be reviewed by Site or course administrators. You are responsible for keeping your own backups of Your Content. You represent that you have the right to provide Your Content to the Site and its administrators.  

It's your responsibility to make clear the licence under which you are providing Your Content. You retain ownership of Your Content. 

By posting Your Content to the Site, you grant TEAM4Excellence a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, sublicensable license to use, reproduce, distribute, adapt, modify, publish, translate, and create derivative works of Your Content for purposes of operating, improving, and promoting the Site and its services. If you apply an open-source license to Your Content, that license remains fully in effect and, in the event of any conflict, the more restrictive terms will govern.

If you close your Account, Your Content may remain accessible on the Site. 


3. Account

Where applicable, you may register for an account on the Site (an "Account"). You must provide current, complete, and accurate information as required by the applicable account registration form. You or each of your authorised personnel must be over the appropriate legal age to create an Account on the Site and you as Registered User warrant that this requirement is met. Site administrators reserve the right to determine at their discretion to cancel/remove your Account.

Each Account may only be accessed and used by each Registered User. In the case of employers, companies, institutions, organisations or similar, the term Registered User shall include their authorised personnel.  Any activity completed through an Account will be deemed to have been undertaken by the Registered User. Where applicable, you may choose to create an Account by authenticating via an existing account you have with a third party, in which case the third party terms may also apply to such action.

You are responsible for the security of your Account and you agree not to share your password or access to the Site with another person. Site is not liable for any loss or damage arising from your failure to keep your Account secure. You will notify Site administrators immediately if your Account information is lost, stolen, or otherwise compromised. Site administrators may suspend or deactivate your Account if it’s determined that this step is needed (such as if your Account has been compromised or you have violated these terms).


4. Your Use of the Site

You will not use the Site in a way that violates any laws or these terms, infringes anyone's rights (including but not limited to intellectual property rights), is offensive, or interferes with the Site or its features. You will follow the Code of Conduct.

For example, you will not use the Site in a way or provide Content to the Site that:

  • infringes, misappropriates, or violates any third party or TEAM4Excellence intellectual property rights;

  • is defamatory, libellous, threatening, harassing, harmful to minors, or pornographic;

  • contains hateful, abusive, obscene, or violent content;

  • attempts to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer, or database connected to the Site;

  • generates or facilitates sending unsolicited email or deploys any robot, spider, or site/search retrieval application;

  • contains or distributes any viruses or programming routines intended to damage, surreptitiously intercept or expropriate any system, data, or information;

  • attempts to or does mine or forge cryptocurrencies, enable illegal file sharing; 

  • restricts or inhibits any other user from using the Site by "hacking", "cracking", "spoofing", or defacing any portions of the Site.

Site administrators are responsible for security of the website. If you wish to report security issues you should contact Site support.

If Site administrators determine that you have acted illegally, in violation of these terms, or inappropriately, they may terminate Your Account, including removal of Your Content, prohibit you from using the Site, take appropriate legal actions, or take other action as deemed appropriate.  Site Administrators have the right, to monitor the use of the Site, any Content, and any activity on the Site. 


5. Posting Guidelines

Advertising commercial products and services using Forums or other resources is strictly prohibited.

Posting unsolicited and blatant advertisements, spam within forum discussions for products and services with no appropriate context are subject to deletion. Such entries, forum discussions, docs or other unwanted content is unacceptable use and we reserve the right to take action in accordance with Section 4 (including termination of your access to the Site).


6. Feedback & Problem Reporting

“Feedback” includes any course-related comments, technical bug reports, or suggestions for new features. You grant TEAM4Excellence a perpetual, irrevocable license to use all Feedback for any purpose, including to develop and improve the Site. For urgent technical or security issues, please contact Site support immediately.

You agree to provide Feedback to Site only in compliance with applicable laws. You represent that you have the authority to provide the Feedback and that Feedback will not include confidential information. 

At Courses.trainingclub.eu, technical and security issues are treated very seriously. If you encountered any problems with Site operation or should you believe you have uncovered a security vulnerability or data breach please contact Site administrators or Site support.


7. Links and References to services

Courses on the Site may provide links to third party websites or resources, which you may access or use at your own risk subject to any applicable third party terms. Courses.trainingclub.eu is not responsible for data handling of third party resources.


8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY AGREED OTHERWISE IN A SIGNED AGREEMENT BETWEEN YOU AND TEAM4EXCELLENCE: 

THE SITE, ANY CONTENT ON THE SITE OR SERVICES PROVIDED ON THE SITE ARE PROVIDED "AS IS" AND TEAM4EXCELLENCE PROVIDES NO WARRANTIES EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. TEAM4EXCELLENCE MAKES NO WARRANTIES THAT THE SITE WILL BE SECURE OR THAT ACCESS AND USE OF THE SITE WILL BE  ERROR-FREE WITHOUT INTERRUPTIONS, CRASHES, OR DOWNTIME.

We may change or discontinue part or all of the Site or any Content at any time.


9. Logos

The Site logos displayed on the Site affiliated with TEAM4Excellence are the property of TEAM4Excellence or other third parties. 


10. Waiver, Severability, and Precedence

The failure of TEAM4Excellence to exercise or enforce any right or provision of these terms does not constitute a waiver of such right or provision.  If any provision of these terms is held to be unenforceable, that provision will be modified so as to be enforceable, or if such modification is not possible, will be removed and the remaining provisions will remain in full force.

Some SIte Content offered may be subject to additional or separate terms. If there is a conflict between these terms and such additional or separate terms, the latter will have precedence with respect to your access and use of that service or Site Content. 


11. Jurisdiction

These terms, and any claim, controversy, or dispute arising out of or related to these terms, are governed by and construed in accordance with the laws of Romania without giving effect to any conflicts of laws provision.

If one or more of the provisions contained in these terms are held invalid, illegal, or unenforceable in any respect by any court of competent jurisdiction, such holding will not impair the validity, legality, or enforceability of the remaining provisions.

TEAM4Excellence and its affiliates respect the intellectual property of others. If you believe that content on the Site infringes your copyright or that your content on the Site was removed in error, please provide the following information to the Site administrator via office@team4excellence.ro:

Pursuant to Article 13 of EU Regulation 2016/679 (the “GDPR”), ASOCIATIA TEAM 4 EXCELLENCE (TEAM4Excellence), with legal address in Constanta, Bd. Mamaia nr. 65, Bl. 1A, Sc.A, parter, Ap.8, Jud. Constanta, Romania, (hereinafter, the “Controller”), provides you with the following information regarding the processing of your personal data.

This privacy notice relates to all personal data we process and addresses the legislation mentioned.

This privacy notice sets out how TrainingClub e-Learning Platform collects and uses information about you when you use our products and services (“services”) and why we collect certain personal data. This notice also explains the choices that you can make about the way that we use your information.

‘Personal data’, in this privacy notice, means any information relating to an identified or identifiable natural person (‘data subject’). An identifiable natural person is someone who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

In order for us to provide you with our services or for correspondence purposes we need to collect your personal data. We ensure that the information we collect and use is confined to this purpose. We always process your personal data for specific purposes, with the nature of the data collected depending on your interaction with us. We are committed to transparency in this.

Our legal bases for controlling or processing personal data are:

  • Article 6.1(a) GDPR (Consent): You provide informed consent to us or have a reasonable expectation that we will use your information in a certain way – for example, to engage in our forum discussions, enroll in courses, and provide necessary support. You can withdraw your consent at any time either by selecting ‘delete my data’ within the specific service or by request to support@team4excellence.ro;

  • Article 6.1(b) GDPR (Contract): Providing our services and fulfilling our obligations to you, usually relating to a terms of service or partnership agreement;

  • Article 6.1(c) GDPR (Legal Obligation): The necessity to meet compliance with our legal obligations; and/or

  • Article 6.1(f) GDPR (Legitimate Interest): Where it is in our legitimate interests to do so. We only rely on ‘legitimate interests’ as the legal basis for processing by us, or third parties we use, for these purposes:

    • recruitment and induction of new employees, contractors and other people who work with us;

    • business development; or

    • providing login systems to users via their existing social media accounts.

Where we rely on a specific basis for processing your information and you wish to object to that processing, you must be aware that it might not be possible for you to continue using our services.

The special categories of personal data (Article 9 of GDPR) we process are:

  • biometric data in the form of facial images, where you have uploaded and we store your profile picture;

  • any special categories of special personal data which any user volunteers while using our services (for example in a forum or submission).

If we need to pass on special category personal data (see Article 9 of GDPR) to a third party, we will only do that in accordance with the legal bases under Article 6 of GDPR as outlined above.

How we collect personal data

TrainingClub e-Learning Platform collects personal data from you when you interact with us. This can be through our websites, in person, including, without limitation, when you:

  • create an individual or corporate user account;

  • request support;

  • register for or participate in an online class, exam, certification, training, or other event;

  • request information or materials;

  • participate in surveys or evaluations;

  • submit questions or comments; or

  • submit content or posts on our forums or other interactive webpages.

How we use personal data

We may need to pass your personal data on to third-party service providers contracted to TEAM4Excellence in the course of dealing with you. We do this because there are services, such as our video conferencing facility, which will not work unless we are able to make these transfers. Any third parties we share your data with are obliged to keep your personal data secure and use it only for necessary service delivery. When your data is no longer required to fulfil the service, those third parties will be directed to dispose of your data in accordance with our standard procedures.

How we store personal data

We will process (collect, store and use) the information you provide in a manner compatible with GDPR. We maintain physical, organisational and technical safeguards for all personal data we hold. We will endeavour to keep your information accurate and up to date, and not keep it for longer than is necessary. How long certain kinds of personal data should be kept are governed by specific business sector requirements and agreed practices. Personal data can be held in addition to these periods depending on individual business needs.

We will process different forms of personal data for as long as it is necessary and proportionate for the purpose for which it has been supplied and we will store the personal data for the shortest amount of time possible, taking into account legal and service requirements.

Marketing

We have no interest in collecting any data beyond that needed to ensure our services work for you. If you are going to be contacted by us for marketing purposes, we will not rely solely on this privacy notice. We will endeavour to seek your consent appropriately. We do not sell data, and have no intentions in doing so in the future.

Your rights when we process your personal data

At any point while we are in possession of or we process your personal data, you have the following rights:

  • right to withdraw consent;

  • right of access;

  • right of rectification;

  • right to erasure;

  • right of data portability;

  • right to restrict processing;

  • right to object;

  • right to object to automated processing, including profiling;

  • right to know;

  • right to opt out of the sale of your personal information, although we do not sell your data;

  • right to judicial review: in the event that we refuse your request under rights of access, we will provide you with a reason as to why;

  • right to be free of discrimination if you exercise your rights;

  • notification of data breaches; and/or

  • the right to lodge a complaint with a supervisory authority.

Where we are your Data Controller, please make your request directly to the Data Protection Officer at office@team4excellence.ro. We will always respond within one month.

However, if we are processing your data on behalf of your Data Controller (your service provider) you should contact them directly.

Where we are not involved with your personal data, you should address your requests to the Data Controller of the website since we have no access to your personal data.
